General Information
An injury can occur to anyone, at anytime, including on the job. You may be eligible for benefits under SC law if you have been injured while at work. You cannot begin to claim benefits until you have notified your employer of your injury. We can help with this. It is important to have a representative to help deal with the insurance adjusters handling your case. Depending on the severity of your injury, you may qualify for a cash settlement.
You can earn up to 2/3 of your current salary per week up to approximately $700.
Depending on your injury, you can receive up to 500 weeks of benefits (in extreme circumstances benefits can be extended for life).
Waiting period: Remember, you only have 90 days to report the injury if you want to collect Workers Comp. If you're past the 90 days, call us and we'll see if we can help.
Types of Disability:
Temporary Total Disability
You can collect this after missing at least 8 days of work.
Permanent Total Disability
Lifetime Total Disability
For brain injuries, paraplegics, and quadriplegics.
Compensation is determined by a schedule assigning a number of week value to the affected body part.
SC Code Ann. § 42-9-30
Computation of Benefits = AWW x .667 x # of weeks x impairment rating
AWW/Average Weekly Wage - average of weekly salary over previous 4 quarters.
# of weeks: value determined by schedule
Impairment rating - percentage of disability of the affected body part as determined by a doctor.
So for example, if you injured your arm while working at a job in which you made $750/week your calculation would be as follows:
AWW = .667 x $750 = $500
According to the schedule, the arm is worth 220 weeks If your doctor determines that you have an impairment rating of 20%, your benefits would be $22,000.
($750AWW x .667 x 220 weeks x 0.20) = $22,000
